The National Carnival Commission Act of 1991 established “a body corporate to be known as the National Carnival Commission of Trinidad and Tobago,” which will report directly to the Minister of Culture.

Section five of the act outlines the following procedures to be undertaken by the minister when composing the commission.

The act states that “the commission shall be managed by a board of commissioners, which shall consists of nine persons who have demonstrated an interest in the cultural or commercial aspects of Carnival.”

Out of these nine commissioners, three were specified to represent; the steelband movement (Pan Trinbago), calypsonians (Tuco) and the Carnival bands.

Historically NCBA has represented the Carnival bands.

For the representation of bands in the NCC, the acts states that the commissioner be “one nominee from the organisation that is most representative of Carnival bands.” The dismissal of a commissioner by the Minister of Culture is also outlined in section five of the act, which allows the minister to terminate the appointment of a commissioner who is found to be derelict in duty or one who chooses to resign.

More importantly the Minister can also terminate an appointment “where the organisation that nominated him requests in writing that the Minister revoke the appointment and appoint someone else.”

The appointment of the six remaining commissioners is referred to as “such other persons as the Minister may appoint.” (CS)
